These Terms of Service (“Terms”) govern access to, and use of, the website and services provided by Tidestone Construction Ltd. (“Tidestone,” “we,” “our,” or “us”). By visiting this website, requesting an appraisal or estimate, or engaging Tidestone for any construction or landscaping work, you agree to be bound by these Terms.

1. Scope of Services

Tidestone Construction Ltd. provides residential and commercial construction and landscaping services, including but not limited to: excavation, landscaping, decks and patios, site preparation, graveling and grading, snow removal, retaining walls, drainage and grading correction, concrete work, hardscaping and stonework, armour stone and rock walls, driveways and pathways, and light demolition or tear-outs. All services are provided subject to availability, feasibility, weather conditions, and applicable laws.

2. Estimates and Appraisals

All estimates, appraisals, or preliminary pricing provided by Tidestone are non-binding and are issued for informational and budgeting purposes only. A project is not considered confirmed, scheduled, or contractually binding until a written services agreement or signed work authorization is executed by both parties. Tidestone reserves the right to revise or withdraw any estimate if material costs, labour requirements, or site conditions differ from initial assumptions.

3. Scheduling, Delays, and Site Conditions

Project timelines are provided as good-faith estimates only and may be affected by weather conditions, availability of materials, changes requested by the client, subcontractor scheduling, or unforeseen conditions such as buried infrastructure, unsuitable soils, or unexpected excavation limitations. Tidestone will make reasonable efforts to meet scheduling commitments but shall not be held liable for delays beyond its control.

4. Changes to Scope of Work

Any modifications to the agreed-upon services, including adjustments to materials, dimensions, layout, or project scope, must be approved in writing. Additional costs arising from client requests or site conditions outside the original estimate may be charged separately as a change order or contract amendment.

5. Materials and Subcontracting

Tidestone reserves the right to select suppliers, materials, equipment, and subcontractors in its professional discretion unless otherwise contractually agreed. Substitution of equivalent or higher-grade materials may be made when product availability or supply conditions require it.

6. Payments

Payment terms, including deposit schedules and billing milestones, will be set out in the project contract or invoice. Tidestone reserves the right to suspend or withhold work if scheduled payments are not made when due.

7. Warranty

Tidestone provides workmanship warranties consistent with industry standards for the region and scope of work performed. Warranty coverage does not apply to damage caused by third parties, owner misuse, neglect, improper maintenance, extreme weather events, or conditions beyond Tidestone’s control. Manufacturer warranties on materials, if applicable, are provided directly by the manufacturer.

8. Limitation of Liability

To the fullest extent permitted by Nova Scotia law, Tidestone Construction Ltd. shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of its services, website, or estimates. Tidestone’s total liability for any claim shall not exceed the total fees paid for the specific project from which the claim arises.

9. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation is unsuccessful, disputes shall be submitted to mediation in Nova Scotia before any legal proceedings are initiated. If mediation does not result in a resolution, the parties agree to binding arbitration. Litigation in court shall only occur as a final recourse and only after arbitration has been attempted.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Nova Scotia and the applicable laws of Canada. Any legal action or proceeding, where not otherwise settled through mediation or arbitration, shall be brought exclusively in Nova Scotia.

11. Amendments

Tidestone reserves the right to update or modify these Terms at any time without prior notice. Continued use of the website or engagement of services following any revision constitutes acceptance of the modified Terms.
